European Union Safe Harbor Data Management
Policy
Database Marketing Solutions participates in
the Safe Harbor Privacy Framework as set forth by the United States
Department of Commerce.
DMS engages in the processing and storage of selected customer and
marketing related information on behalf of our European Union (EU) clients. This may
include personal information such as contact detail or data used for
the management of the EU client’s business. DMS does not sell, rent
or lease the data obtained from these clients. Each EU client
recognizes and agrees to “ownership” of the data protected by the
safe harbor framework. This means that our EU clients are
responsible for complying with the data protection legislation in
the applicable EU Member State before transferring their customer
data from the EU to US. This ensures that the data subjects have
been provided with the proper Choice regarding how their personal
information may be used. DMS, therefore, as a data processor on
behalf of EU clients, is not required to apply other Safe Harbor
Principles to the personal information received from the client.
DMS expressly follows EU client direction or as required by law when
processing data. Any information identified as sensitive by EU
clients will be treated accordingly.
DMS uses a variety of industry standard security technologies and
procedures to safeguard personal information from loss, unauthorized
access, misuse, alteration, disclosure or destruction. DMS maintains
personal information on secure systems within a controlled facility.
Only authorized persons with a specific business purpose for
maintaining and processing personal information and data have access
to the data stored by DMS on behalf of EU clients.
As part of our participation in Safe Harbor, we have agreed to the
Direct Marketing Association Party Dispute Resolution process for
disputes relating to our compliance with the Safe Harbor Privacy
Principles. If you have any complaints regarding our compliance with
the Safe Harbor framework, first contact DMS at
privacy@database-marketing.com.
Dispute resolution will be conducted in English.
If contacting us does not bring resolution, you may file your
complaint with the Direct Marketing Association.
